TERMS:

By submitting your order to Mountaintop Adventure Reservation Services (MARS), you are allowing us to make your reservations and you are aware of and agree to all of the following:

General Information
Vacation reservations are being processed by Mountaintop Adventure Reservation Services (MARS). MARS serves as a booking agent for reservations. We fill your reservation request immediately and will attempt to get a confirmation back to you via the e-mail address you provided within 72 hours of receipt of your order. In most cases lodging and activity vendors require either the first night's stay or the entire booking amount be charged to your credit card in order to secure your reservation. It is your responsibility to review the correctness of all information you enter on the reservation forms before submitting them to MARS. In the event we are unable to make reservations for the date(s) you request, nothing will be billed to your credit card.

Privacy and Security
We offer the safest encryption process available (128-bit RSA) to ensure your credit card and private information is treated responsibly. Your information will be "scrambled" using the highest-strength technology available before being sent across the Internet to us. We collect no personal information about you when you visit our website unless you choose to provide this information to us. However, we may collect and store certain statistical or demographic information automatically. This information does not identify you personally. You will not be placed on any "junk mail" lists, e-mail, snail mail, or otherwise by visiting or making a reservation on our site. You may wish to review our compete privacy statement before making any reservations online.

Vendor Pricing
Prices are set by either the National Park Service or the individual vendor. Prices may or may not include taxes, depending on the vendor(s) involved. We ONLY work with vendors who are approved concessionaires of the National Park Service, the United States Forest Service or are in good standing with local community Chambers of Commerce or local Better Business Bureaus. Each reservation, activity, tour or event will be billed per the terms of the individual vendor.

Travel Agent Service Fee
For all reservations we get you the ''best available'' lodging, at or below the price you indicate. For lodging and activity reservations we make, including lodging, tours, snowmobile rental, snowcoach tours and activity reservations, a 10% non-refundable service fee (or "travel agent booking fee") is charged separately to your credit card as as "Mountaintop Adventure Reservation Services" for the total dollar amount of reservations we make. The 10% service fee may or may not include the taxes for any reservation. In the event the 10% fee is less than $10, you will be billed the non-refundable minimum service fee of $10. In the event we or our agents are not able to make reservations for you, you will not be charged any service fee, and we will destroy your paper work to protect your personal information.

The online form you fill out is a reservation request; it is not a request to check availability. This fee is for the service we provide to you, including but not limited to: correspondence and/or phone calls we make to vendors in the park area, and other travel agent services on your behalf necessary to secure your lodging and/or other reservations.

Park Fees
The National Park Service has additional fees for entering the National Parks. It is your responsibility to pay these fees, as they are not part of any reservations we provide for you. We encourage you to purchase an "annual pass" good for a year from month of purchase and good nationwide at approved National Park locations. The National Park Service also has approved the concessionaires to charge additional fees for electricity and other uses. These fees are not collected or charged by MARS. You may obtain passes in advance by visiting www.nationalparks.org, or call toll free at 1-888-GO-PARKS.


Changes or Cancellations of Your Reservations

Should you need to change the dates of your stay (but not cancel your trip), you may wish to contact the vendor directly for the quickest response (the phone number and reservation confirmation number should be in the e-mail you received from us). Alternatively, you may reply to us via e-mail (reply to the e-mail confirmation you received from us) and request changes to your dates of stay. This email will usually include a reservation confirmation number from the lodging or activity vendor; we will need this number in order to attempt to make changes to your dates of stay. We will attempt to make your changes and notify you within 72 hours of receipt of your request.

If you wish to cancel your reservations completely, you may contact the lodging vendor (hotel, motel, lodge, etc.) directly at the phone number we provided to you in your e-mail reservation confirmation. This is the quickest and surest method of cancellation. Alternatively, you may reply to us via e-mail (reply to the original e-mail reservation confirmation we sent you, which includes your confirmation or reservation number and the dates of your stay), and we will attempt to place the cancellation on your behalf within 72 hours of our receipt of your request. We do not charge any additional service fees for cancellations, although some lodging or activity vendors may have varying requirements of their own. Please be aware that many lodging vendors require at least 7 days advance notice to refund your credit card deposit. In no case will MARS be responsible for non-refunded or non-refundable charges made by the lodging vendor if you do not cancel within the terms of that vendor. The service fee we bill for making your reservations is non-refundable, except in the event of an error on our part. We recommend you make any cancellations as soon as possible, and no less than 7 days before your scheduled arrival day. We also recommend you contact the hotel or other vendor directly to determine any specific cancellation or other policies they may have.

The vendor determines the deposit required for your reservation. Deposits may be in the form of a first night's deposit, or the full or a partial amount of the reservation total. Summer season cancellations must be made at least 7 days before arrival or the terms of the individual vendor, whichever is greater. Yellowstone Winter season reservations must be canceled 21 days before arrival or the terms of the individual vendor. Deposits may be charged and/or may not be refunded for any reason if you fail to cancel within the terms listed here. You must receive an official cancellation number or the name of the lodging/activity person who cancelled the reservation for the cancelation to be completed. Sending an email is not adequate proof a reservation has been or will be canceled. We are not responsible for lost or misdirected emails or other circumstances beyond our control.

Non-MARS Services
Any bookings made through affiliate services such as, but not limited to, expedia.com or travelnow.com are NOT charged any additional service fees by MARS. MARS is not responsible for any content provided by outside agents such as expedia.com, travelnow.com, or any other affiliates, or their subsidiaries or parent companies.

Lodging Amenities
We may not be able to get you a heated or indoor pool or related amenities at some locations between October and May because of availability and other reasons beyond our control. Most lodging locations within national parks do not include "luxury" items such as color television or in-room telephones, although a telephone for public use may be located within the facility or nearby. Many lodging locations within the park offer shared or public bathing facilities, rather than private in-room facilities.

Safety
Your safety is a top priority and only the Outfitter, Rafting Manager or an authorized person for the specific activity will determine if a trip should be canceled. The trips may be delayed for weather to "clear up". It is your responsibility to be aware of -- and obey -- local and/or state laws and safety regulations for any area you are visiting.

It is your responsibility to be aware of all National Park Service rules and regulations concerning leaving food and children unattended, as well as rules and regulations concerning not approaching, feeding or leaving food an animal may attempt to approach. You will also be aware of and obey National Park Service rules and regulations for speed limits while driving and while walking to only walk on designated trails. This list does not include all law enforcement rules and regulations, as you agree it is your responsibility to make your self aware of those and you agree MARS has told you that travel to and from and within and near a National Park may have safety concerns and your safety and those within your party are your responsibility. You also agree it is your responsibility to contact the National Park Service or any other law enforcement or government agency to be aware of any situation which may arise concerning any safety issue. You are asking MARS to only make reservations, and you agree it is your responsibility to know of and be aware of any issue concerning the safety of you and those you will be traveling with and coming in contact with.

Miscellaneous Information (Please Read!) For your security, we normally make all replies and contact with e-mail. We do not make any commitment to return phone calls for reservations. We do not guarantee we will be able to make any reservations you request. For your protection, we may ask for identifying personal information (for example, your full name, home phone number, or date of birth) over the phone should you call concerning a reservation, cancellation, etc., especially such information that may be required by your credit card company.

You are responsible for reviewing the online order carefully before clicking on the "Press to Make Reservations" button or otherwise submitting your order. You may click the "Clear the Form" button if you choose to not proceed with the order. If we are not able to fill your reservation as stated on the form, we will not charge any fee. If we cancel your reservation at your e-mail reply request, we will notify you at the email address you provided on the form for the original order, and will provide you with the official cancellation number or the name of the vendor personnel responsible for canceling the reservation. No cancellation is complete without you receiving an official cancellation number or the name of the vendor person who is responsible for canceling the reservation. We only cancel reservations made through our service. The name of any MARS person you may have is not sufficient proof a reservation has been canceled. You may be charged deposits, or may not receive a refund of deposits if you do not cancel your reservation as stated within the terms listed on this page. You may request to cancel a reservation at any time; however this does not guarantee a refund or not being charged a deposit if you fail to cancel within the stated terms or the terms of the lodging or activity vendor.

Should our agent call you at your request, then you will be responsible for paying a 10% service fee for the total dollar amount of reservations made on your behalf. We do not make any commitment to return phone calls for reservations. We do not guarantee we will be able to make any reservations you request.

We do not make any accommodations for pets.

On all reservations we make, we shall request non-smoking accommodations if you so indicate, and if they are available. However, we can not guarantee the lodging will be non-smoking, and we may reserve a room designated as ''smoking'' if that is all that is available.

Some locations provide cribs for infants; you may request these at the front desk when checking in. There may be a small additional charge, which you may pay at check-in.

MARS is not responsible for any cancellations or schedule changes due to travel delays, road conditions, weather, or any other reason including, but not limited to: fires, floods, snow, any acts of nature, acts of terrorism or war, or acts of God. We are not responsible for anything related to your snowmobile rental or snowcoach tour, rafting trip, horse rental, or other tourist activity, including, but not limited to, mechanical problems, equipment malfunctions or problems, road conditions, or accidents resulting in injury and/or property damage. Additionally, MARS is not responsible for any errors or problems beyond the scope of our control, such as, but not limited to: lost, misdirected, or never received e-mails, e-mail server downtime, Internet or website outages, or any type of computer, server, hardware or software malfunction, error, or downtime.

Prices do not include park entrance fees. Prices may change without notice by the National Park Service, any vendor, each hotel, tour operator, outfitter, snowmobile or snowcoach company. A valid driver's license is required to operate a snowmobile in Yellowstone and all National Parks. For most vendors pricing for reservations, an adult is considered anyone age 12 or over. All minors, under age 18 must be accompanied by a parent or guardian at all times for tours and activities we reserve.

Credit Card Users
By placing a reservation or other order with us involving a credit card, you are stating that you are a fully authorized user of that credit card, and authorize the request to bill your card. All transactions are in US dollars ($) unless otherwise stated.

Your credit card company (Visa, MasterCard, American Express or Discover/Novus) will be the final Arbitrator in the event of a dispute over any charges made to your credit card. The full amount of any liability of MARS will only be the total amount of service fees or processing fees charged by MARS. We encourage you to contact your credit card company with any dispute you feel should be resolved. You should make the credit card company aware that you read and agreed to the official terms on this page as a condition of doing business with MARS, and you were not coerced into pressing the "Make my Reservations" button or otherwise sending an online order to MARS by any person(s) at MARS.

By clicking the "Press to make reservations" or "Submit" button (or by otherwise submitting an online order to MARS, you are allowing us to make your reservations and bill your selected credit card, and you are aware of of and agree to all of the above.
